1. Who we are and acceptance

Orbity is a platform that connects people looking for work ("candidates") with companies hiring near them ("companies"), through a map of job openings. It works through the Orbity app for iOS and Android and the website orbityjobs.com.

Orbity is operated by TOOL APP, S.A.S. DE C.V. ("Orbity", "we"), a Salvadoran company registered in the Commercial Registry of the Centro Nacional de Registros under company registration no. 2025126210, tax ID (NIT) 0623-110925-104-0, with its registered address at Calle El Carmen, Colonia Escalón, San Salvador, El Salvador.

By creating an account or using Orbity you accept these terms and our Privacy policy. If you do not agree, do not use the service. Orbity is only for people aged 18 or over.

2. What Orbity does

Companies register their locations on the map and publish job openings at each one. Candidates see the openings near them on the map, create their profile (with a CV and, if they wish, an introduction video) and apply. The company reviews each application and decides; when it accepts a candidate, it can get in touch through the means Orbity offers, for example WhatsApp.

A company can publish openings as anonymous: in that case its name is not shown until it accepts a candidate.

Orbity is an intermediary. We are not the employer, we are not a party to any employment relationship that may arise, and we do not guarantee that an application leads to a hire or that an opening is filled. Each company is responsible for its openings and its hiring decisions.

3. Your account

  • Provide true information and keep it up to date. Each account is personal.
  • Keep your password secret. You are responsible for what is done with your account; if you think someone else is using it, tell us right away.
  • Whoever registers a company confirms that they are authorised to do so and to accept these terms on the company's behalf.

4. Rules of use

You may not:

  • Publish false, misleading, illegal or discriminatory openings, or openings that do not correspond to a real job at the location shown.
  • Charge candidates for applying, for an interview or for a position.
  • Use candidates' data for anything other than the hiring process for the opening they applied to, or share it with third parties.
  • Impersonate another person or company, send spam or harass other users.
  • Copy data from the platform by automated means, interfere with how it works or try to breach its security.

Companies must comply with the applicable employment law in their openings and hiring processes.

5. Content you publish

The content you upload (profile, CV, video, logo, photos, openings) remains yours. You allow us to store, display and process it only as far as needed to provide the service; for example, to show your profile to the company you apply to, or your opening on the map. You confirm that you have the right to publish that content.

We may remove content that breaks these terms or the law and, if the breach is serious or repeated, suspend the account.

6. Company plans and payments

  • Plans, prices and conditions are those published on orbityjobs.com at the time of purchase. Prices are shown in US dollars or, where indicated, in euros.
  • Company payments are processed by Paddle, which acts as reseller and merchant of record for the purchase. Paddle issues the invoice and its purchase terms also apply. Orbity does not receive card details.
  • The Urgent plan is a one-time payment for one month. The other plans are charged for the chosen period and renew automatically at the end of each period unless you cancel before.
  • If you cancel, the plan stays active until the end of the period already paid. Periods that have already started are not refunded, except where the law requires it.
  • Promotions (for example, free months) apply as described in the offer.

7. Free and premium use for candidates

Searching for openings and applying is free for candidates. If we offer a premium subscription, it is bought inside the app through Apple's App Store or Google Play; in that case that store's payment, renewal and refund terms apply, and the subscription is managed and cancelled in the store settings.

8. Availability and changes to the service

We work to keep Orbity running well, but we cannot guarantee that it will always be available or free of errors. We may improve, change or withdraw features; if a change significantly affects a current paid plan, we will let you know in advance.

9. Liability

As far as the law allows, Orbity is not liable for the accuracy of openings and profiles published by users, for hiring decisions, for how users behave towards each other, or for indirect damages or loss of profit.

Nothing in these terms limits our liability where the law does not allow it to be limited, for example in cases of intent or gross negligence, nor the rights that the law gives consumers.

10. Closing your account

You can stop using Orbity whenever you want. Companies can delete their account from the company profile in the app, with 14 days to change their mind. To delete a candidate account, write to us at support@orbityjobs.com; very soon you will also be able to do it from the app. What happens to your data is explained in the Privacy policy.

We may suspend or close an account that breaks these terms or the law, or that does not pay for a purchased plan. Except in serious cases, we will warn you first.

11. Intellectual property

The Orbity and OrbityJobs brand, the logo, the app, the website and their software belong to Orbity or its licensors. We give you a personal, non-exclusive and non-transferable licence to use the app in accordance with these terms.

12. Changes to these terms

If we make important changes to these terms, we will let you know in the app or by email before they take effect. If you keep using Orbity afterwards, you accept the new terms; if you disagree, you can close your account.

13. Governing law and jurisdiction

These terms are governed by the laws of the Republic of El Salvador, and any dispute will be submitted to the competent courts of San Salvador. If you use Orbity as a consumer from another country, you keep the protection given to you by the mandatory rules of your country of residence.
